Ok. As an artist working as a designer in tech specifically for the past 6 years in AI. I have been an avid reader of your work it’s great. Here’s where I find contradiction. I think you know that lawyers and the law in general is complicated worked. Simply based on lawyers using a number of laws by framing them in ways most advantageous to their clients in courts of law. IP law and trademark law is especially complicated. And it took me asking dozens of lawyers to get an answer. Ai companies aren’t JUST replicating original artworks. The outputs aren’t just stealing fractions of percentages of IP under the Millennium Copyright Act the section you so frequently mention on this blog. THEY ARE REVERSE engineering it. And not just a nuance. I’ve treated these Algorithms myself . They output in detail how to achieve the same results as famous artists work “step by step”. And as I reference your previous articles fair use no longer applies when it’s egregiously profit based. And some of the most prominent legal minds in IP law said there is a case for this in relation to the section of the DCMS you find most unjust. Is the exact same section that ironically can be used against these companies. You argue that art is not rational but that’s a false POV based on your own experience of rationality. It’s a false equivalency many people with backgrounds deeply rooted in engineering mistake. Art has existed since we have existed. They. Chose. To. Automate. The. Art. First. That should tell you something right there. But if you’re an artist who cares deeply about your work as I am. You have spent the past couple of years in mourning. Nearly ready to fall apart. As I see these idiotic posts by prompt wizards attempting to techsplain how to most effectively write a freaking sentence. To achieve the always unpredictable visual results of an llm I’ve never seen any of these frauds claiming to be AI artists use any artistic terminology. I’ve never heard of and especially abhorrent midjourney founder mention having artists on staff. You know bc you have written about this that these mediocre assholes rushed these products to market they could have done things the right way. But predictably they chose the path of least resistance to making profits. They will be sued lawsuits will pile up. Read about Lynn goldsmith v the Andy Warhol foundation that artist goldsmith just won a little over a year ago.
